A person or business that collects batteries and doesn’t sort or treat them need not be an ABTO or ABE but must follow the waste duty of care. You must store all waste in a way that allows easy inspection. You must maintain safe access between piles of wastes. There must always be pedestrian and vehicular access (for example, forklift) to the whole of the storage area. You must document evidence of any testing or pre-treatment done to remove all hazardous components and other materials unsuitable for metal recovery. This must be available on request. If you cannot do this you must ship the waste as notified waste. You must store all waste batteries you accept as an ABTO or ABE in places with impermeable surfaces and suitable weatherproof coverings. Or the containers you use must have similar characteristics.

The Health and Safety Executive has just announced that the Buxton H&S Laboratories are to research the storage and handling methods for batteries. The problem is that we do not know when they will give us the results, and it certainly won’t be before the new regulations come into force. Would a new battery have greater capacity than an old one? Sure. But the one you have is free while a new one isn’t. If you need or want the extra capacity, go for it–either for longer runtime with house loads, or more cranking power. But your old battery isn’t going to ruin the new ones.
