In their judgment, Lord Reed explained that there was a legal rule that refugees must not be returned to their countries of origin, either directly or indirectly, if their life or freedom would be threatened in that country. That rule is known as non-refoulement. In delivering the Supreme Court’s verdict, Lord Reed cited three key reasons identified by the appeal court why they believed asylum seekers who are sent to Rwanda are at real risk of refoulement, and that the policy was therefore unlawful. The issue the court has to decide is whether the Home Secretary’s policy breaches that prohibition.
